PodGlo may, in its sole discretion, modify or alter these Terms of Service and policies at any time, and you agree to be bound by such modifications or alterations. If you do not accept and abide by this Agreement, you may not use any of the PodGlo services.

Nothing in this Agreement shall confer any third-party rights or benefits. 1. PodGlo is a social commenting system (the "Service"). You will be responsible for all actions, activities, posts and uploads occurring under your username. You are responsible for keeping your password secure. You may not share or reveal your password to any other person. You understand and agree that the Service is provided to you on an AS IS and AS AVAILABLE basis with no service level guarantee. PodGlo disclaims all responsibility and liability for the appearance, availability, security or reliability of the Service or any software under the control of PodGlo. PodGlo reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you or any third party. PodGlo reserves the right to refuse service to anyone at any time without notice for any reason. You must be at least thirteen (13) years of age to use the Service.

2. You agree to abide by the PodGlo Content Policy (http://www.podglo.com/podglotos.php). You should periodically review the most up-to-date version of the Content Policy. PodGlo may, in its sole discretion, modify or amend the PodGlo Content Policy at any time, and you agree to be bound by such modifications or amendments. You agree that you are responsible for your own use of the Service, for any posts you make, and for any consequences that arise due to your use of the Service. You agree that your use of the Service will be in compliance with all applicable local, state, national, and international laws, rules and regulations.

3. Violation of the PodGlo Content Policy, or any terms in this Agreement, may result in termination of this Agreement. PodGlo reserves the right, but shall have no obligation, to investigate your use of the Service. Content on any PodGlo Service is provided by and is the responsibility of, the person who made such content available on the Service. PodGlo does not monitor the Service content and takes no responsibility for such content. PodGlo provides access to such content as a service to you.

4. As a condition of using the Service, you agree to be bound by the terms of the PodGlo Privacy Policy (http://www.podglo.com/podglotos.php), which may be amended time to time. You agree that PodGlo may store, access or disclose your personal information, including the content of your communications, if PodGlo is required to do so in order to comply with any valid legal process or governmental request. Personal information collected by PodGlo may be stored and processed in the United States or any other country in which PodGlo Inc. or its agents maintain facilities. By using the Service, you consent to any such transfer of information outside of your country.

5. You agree that PodGlo has no responsibility or liability for the deletion of, or the failure to store or to transmit, any user content on the Service or intended for upload to the Service. PodGlo retains the right to limit use and storage at any time with or without notice.

6. PodGlo does not guarantee the truthfulness, accuracy, or reliability of any posts made via the Service, nor does PodGlo endorse any opinions expressed via the Service. You agree that any reliance on content posted via the Service will be at your own risk.

7. PodGlo takes no responsibility for third-party content. PodGlo does not have any obligation to monitor such third-party content. PodGlo reserves the right to remove any content on the Service. PodGlo reserves the right to review, store and disclose any content or metadata to satisfy any applicable law, regulation, legal process or government request. PodGlo reserves the right to store and disclose any content or metadata to enforce this Agreement, and to detect or prevent fraud, security breaches, safety issues or technical issues, and to respond to user support requests. PodGlo will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.

8. You acknowledge that PodGlo owns all rights in and to the Service, including all intellectual property rights. PodGlo's intellectual property rights are protected by U.S. and international intellectual property laws. You agree that you have all intellectual property rights to the content submitted to PodGlo. PodGlo claims no ownership of, or control over, any content submitted by you to the PodGlo Services. You retain all patent, trademark and copyright to any content you submit. You agree that you will not copy, modify, or create works derived from the Service. You are responsible for protecting your own intellectual property. By submitting content to PodGlo services, you grant PodGlo a worldwide, non-exclusive, royalty-free license to reproduce and publish such content on any PodGlo services. PodGlo reserves the right to refuse to publish any content.

9. You agree not to copy, sell, or exploit for any purpose any part of the service.

10. PodGlo may terminate the service, this agreement, or your account. In the event of termination, your account will be disabled and you will not be able to add new content to the service.

11. Indemnification. You agree to hold harmless and indemnify PodGlo, its officers, agents, and employees from and against any third-party claim arising from or related to your use of the PodGlo service. This includes any liability or cost arising from all claims, losses, damages, suits, judgments, and attorneys' fees.

12. This Agreement constitutes the entire agreement between you and PodGlo.

13. These Terms of Service will be governed by laws of the State of New Jersey.

PodGlo Privacy Policy

This Privacy Policy describes how PodGlo uses personal information that you supply when signing up for the service. 1. PodGlo asks for limited personal information, including your email address, phone number, and a password. 2. You may also provide a photo or avatar image that will be displayed next to your PodGlo submissions. 3. PodGlo servers automatically record information about your use of the service. 4. PodGlo stores your account information and copies of all your submissions to the service. 5. PodGlo will never sell or transmit your personal information to a third party.

PodGlo Content Policy

1. You agree to not submit any content which is offensive, obscene, hateful, or indecent, or which violates the rights of any other person. 2. You agree to not threaten anyone, promote violence or exhibit any behavior which would be a civil or criminal offense. 3. You may not use the PodGlo Service to send unsolicited or unwanted email, IM, voice, or text messages to anyone. 4. You agree not to upload worms, trojans, viruses, or any other malicious code.
